Notice of Intent

What is a notice of intent? 


A Notice of Intent (NOI) is an application requesting coverage under the Construction General Permit (CGP) TXR150000. The General Permit allows contractors and developers to discharge stormwater into state waterways, provided they comply with the permit's terms. 

  

It is a requirement for contractors and developers to develop a Stormwater Pollution Prevention Plan (SWPPP), then submit their TCEQ Notice of Intent to obtain coverage. Based on the size of the project site, there are two options for obtaining coverage under the General Permit.


  • Sites disturbing less than 5 acres can receive automatic authorization by completing a Small Construction Site Notice (CSN) and submitting it to the local regulatory agency at least two days before starting construction.
  • Sites disturbing over 5 acres or that are part of a common plan of development disturbing five or more acres must submit a Notice of Intent through the State of Texas Environmental Electronic Reporting System (STEERS), pay the $225 application fee, and submit your NOI to the local regulatory agency two days before starting construction.
