Notice of Intent

What is a notice of intent? 


A Notice of Intent (NOI) is an application requesting coverage under the Construction General Permit (CGP) TXR150000. The General Permit allows contractors and developers to discharge stormwater into state waterways, as long as the contractors comply with the terms of the permit. 

  

It is a requirement for contractors and developers to develop a Stormwater Pollution Prevention Plan (SWPPP), then submit their TCEQ notice to obtain coverage. Based on the size of the project site there are two ways for obtaining coverage under the General Permit.


  • Sites disturbing under 5 acres can receive automatic authorization by completing a Small Construction Site Notice (CSN) and submitting the notice to the local regulatory agency two days prior to starting construction.
  • Sites disturbing over 5 acres or are part of a common plan of development disturbing 5 or more acres must submit a Notice of Intent through the State of Texas Environmental Electronic Reporting System (STEERS), pay the $225 application fee, and submit your NOI to the local regulatory agency two days prior to starting construction.
